Political Donations

NSW Local Government and Planning Legislation Amendment  (Political Donations) Act, 2008.

Please note this new State legislation comes into effect from next Monday 15 September 2008.

The Act is intended to improve the transparency of the planning system by requiring disclosure of any political donations, or gifts, made to a consent or other planning authority such as Councils or the NSW Government/Minister for Planning.
 

 
In particular, the Act introduces disclosure requirements for individuals or entities with a relevant financial interest as part of the lodgement of:

  • various types of development proposals, or
  • requests to initiate environmental planning instruments or development control plans.
Disclosure requirements also apply to individuals or entities lodging submissions in objection to or support of the above types of proposals.

These disclosure requirements apply to those who have made a “reportable political donation” or “gift” to a local Councillor or Council employee within
the period commencing two years before a relevant application or submission is made and ending when that Application is determined. 

Any such donation or gift, if applicable, must be disclosed in writing and returned to the relevant authority, whereupon it will be made public (for example on a Council’s web site)
